Order Confirmation/Cancellation

If you want to cancel or there is a problem with your Order, please telephone us as soon as possible on 01666 826841.

Although we endeavour to ensure our website is fully up to date, there remains a slight possibility that it may not be entirely reflective of the goods on offer due to the nature of how we cut and sell.  We will contact you as soon as possible in the unlikely event that we cannot fulfil your Order.

Returns & Refunds

We would welcome any opportunity to put right an Order that our customers would not be entirely happy with.  Online customers and those who purchase from the Shack are protected by consumer contract law.

If you would like to return an unused, damaged item, please let us know by email helen@fabricshack.co.uk, telephone 01666 826841 or call in and we will arrange for your return to be processed.  Please obtain Proof of Posting and we will refund your costs (including postage) within the statutory timeframe once they have been received.  Please note we are unable to process returns for damaged items after 30 days from the day of receipt.

If you are unhappy with your purchase, but it is not damaged, please contact us as above at the earliest convenience within 14 days of receiving your goods.  We will arrange for a goods return and will refund the cost of the goods if they are still in a condition where we are able to resell them.  Please note that the customer will be responsible for any returns postage and it is recommended that a Proof of Posting is obtained.

 Loyalty Cards/Promotional Offers

We are pleased to be able to be able both our online customers and our local users various promotional activities throughout the year.  Online and in store promotions will be unique to the market place and not transferrable to another e.g. online promotions will only refer to purchases made through www.fabricshack.co.uk and will not be valid for goods on sale on Ebay. Terms and conditions will be specific to the promotion, and we reserve the right to cancel these without notice.  Loyalty and collector cards are issued to individuals and are not transferrable.  Points/stamps for collectors will be issued when a fabric purchase is made in store, one per visit.  Your free ½ M can be claimed on your next purchase, the cheapest product is free.

Pricing & VAT

All our prices are in UK Pounds Sterling.  We are not currently VAT Registered.

 

Privacy Policy 22nd May 2018

 This Privacy Policy describes how and when we collect, use, and share information when you purchase an item from us, contact us, or otherwise use our services through our website, sales platforms we use, social media platforms and their related sites and services.

This Privacy Policy does not apply to the practices of third parties that we do not own or control, including Ebay, Etsy, Shopify or any third party services you access through these, this also includes payment card data collected by the merchant when you make a purchase in store.  You can reference these individual polices through their websites.

  1. Personal Information Collected

 To fulfil your order, you must provide us with certain information (which you authorised my sales platforms to provide to us), such as your name, email address, postal address, payment information, and the details of the product that you’re ordering.  You may also choose to provide us with additional personal information (for a custom order  for example).

  1. Why We Need Your Information and How We Use It

 We rely on a number of legal bases to collect, use, and share your information, including:

 as needed to provide our services, such as when we use your information to fulfil your order, to settle disputes, or to provide customer support;

  • when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for our mailing list;
  • if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
  • as necessary for the purpose of our legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving our services. We use your information to provide the services you requested and in our legitimate interest to improve our services; and 2) Compliance with the Seller Policies and Terms of Use.

 Information Sharing and Disclosure

 Information about our customers is important to our business. We share your personal information for very limited reasons and in limited circumstances, as follows:

 We share information with sales platforms/merchant services as necessary to provide you our services and comply with our obligations under both their Seller Policies and their Terms of Use.

  • Service providers. We engage certain trusted third parties to perform functions and provide services to our shop, such as delivery companies. We will share your personal information with these third parties, but only to the extent necessary to perform these services.
  • Business transfers. If we sell or merge the business, we may disclose your information as part of that transaction, only to the extent permitted by law.
  • Compliance with laws. We may collect, use, retain, and share your information if we have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of our customers, or others.

 Data Retention

 We retain your personal information only for as long as necessary to provide you with our services and as described in my Privacy Policy. However, we may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce our agreements. I generally keep your data for the following time period: 4 years.

  1. Transfers of Personal Information Outside the EU

 We may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, we may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If we deem it necessary to transfer information about you outside of the EU, we will rely on Privacy Shield rated services as the legal basis for the transfer.

 If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. These are:

  • You may have the right to access and receive a copy of the personal information we hold about you by contacting us using the contact information below.
  • Change, restrict, delete. You may also have rights to change, restrict our use of, or delete your personal information.  Except in exceptional circumstances (like where we are required to store data for legal reasons) we will generally delete your personal information upon request.
  • You can object to (i) our processing of some of your information based on our legitimate interests and (ii) receiving marketing messages from us after providing your express consent to receive them. In such cases, we will delete your personal information unless we have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
  • If you reside in the EU and wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

Shopify

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Third Party Providers

We use Worldpay as a third party provider for the handling of our credit card data in store.

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

Third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

Security

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Cookies

Here is a list of cookies that that Shopify use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.

 _session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).

 _shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits

 _shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.

cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.

 _secure_session_id, unique token, sessional

 storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

Age of Consent

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Restricted Sales

In store we sell a number of items that are age restricted, namely blades and glues.  We cannot by law sell these to Under 18’s.  If you are lucky enough to look under 25, please don’t be offended if we ask for proof of age if you are buying these products.
